You agree not to use our website: In any way that violates any applicable federal, provincial, local, or international law or regulation; To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website & software, or which, as determined by us, may harm ePlatform or users of the website or expose them to liability; To impersonate or attempt to impersonate ePlatform, an ePlatform employee, another user, or any other person or entity; To upload, transmit, or distribute any content that is unlawful, defamatory, obscene, pornographic, or otherwise objectionable, or that infringes on any intellectual property rights or privacy rights of any third party; To transmit any malicious software or code, or to interfere with the operation of our website & software or any user's computer or device.Intellectual Property: Our website & software and its entire contents, features, and functionality are owned by ePlatform or its licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.User Content: Any content that you upload, transmit, or post on our website & software remains your sole responsibility. We will use commercially reasonable measures to protect the confidentiality of any non-public information that you provide to us.Refund Policy: We do not offer refunds for our services. However, if you submit a cancellation request in writing [email protected] your next scheduled payment, we will not charge you for that payment.Cancellation Policy: All of our subscriptions are no-contract and clients are free to cancel with a minimum of 30 days notice from their next billing date. Prior to cancellation it is your responsibility to ensure all media assets, customer lists, configured features (templates, workflows etc.), funnels, websites, and phone numbers are transferred or removed from service. Once your cancellation is processed this is irreversible and all data within the system will be purged including any phone numbers purchased through the system. If you'd like to transfer out any actively used phone numbers it will be your responsibility to submit the porting request to do so. In lieu of cancelling your account permanently you may opt to suspend your billing for a short specified period of time after which point we will be able to resume your account. During this time all access, communications (Phone/SMS/Email), websites, automations, and other services will be paused. You will be responsible for the direct maintenance fees of phone numbers charged by the carrier however they will not be terminated/released. All functions and billing will automatically resume after the specified period of time. Suspensions are limited to 90-day spans after which billing will resume for a minimum of 30 days.Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall ePlatform or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the use or inability to use our website or software.Governing Law: These terms and conditions and any disputes arising out of or related to your use of our website shall be governed by and construed in accordance with the laws of Canada.Changes to These Terms and Conditions: We reserve the right, at our sole discretion, to modify or replace these terms and conditions at any time. What constitutes a material change will be determined at our sole discretion.Rates Apply For Communication & AI Usage: Call minutes cost $0.026/min to make and $0.017/min to receive, phone numbers are $2.30/mo, text messages are $0.015/segment (160 characters per segment), emails are $0.0014/email, email verifications are $0.002625/verification, premium workflow actions are $0.0105/premium action, content AI is $0.0945/1000 words and $0.063/ image, workflow AI is $0.0315/workflow AI, and conversation AI is $0.0525/message. With $10 USD, you can expect to receive approximately 385 call minutes, or 665 text segments, or 7145 emails. Communication & AI rates are in USD. If a user breaches our terms and conditions, we reserve the right to terminate their access to our website & software and services without notice. We may also take any legal action we deem necessary to protect our rights or to comply with applicable laws and regulations. We will cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through our website & software.
